This incentive scheme (‘Incentive Scheme’) is open to Hewlett Packard Enterprise (“HPE”) Gold and Silver Partners based in the UK & I having a HPE Partner Agreement (“Qualifying Partners”). It is also open to qualifying UK & I Distributors. Registration for, and participation in, the Incentive Scheme constitutes full and unconditional acceptance of these terms and conditions (“Terms”).
The Incentive Scheme runs from 01/05/2019 up to and including 31/07/2019 (the “Incentive Term”).
Any personal data which you may provide when you participate to this Incentive Scheme will be used by HPE and, if applicable, its subcontractor(s), only for the purpose of this Incentive Scheme and in accordance with the current HPE privacy policy available on the HPE website https://hpe.com/uk/en/legal/privacy.html
Partners achieving their “Sales Target” will be invited to send one employee representatives on a weekend trip to Abu Dhabi (the “Event”).
The “Sales Target” shall communicated separately by HPE to each Qualifying Partner. The Sales Target shall be based on HPE revenue attributable to Qualifying Products ordered from and Authorised HPE Distributor during the Incentive Term. All orders must be placed on or before 31st July 2019 to be counted.
“Qualifying Products” are the Microsoft Products within Product Line J3, HPE Server Options products from product lines SI & SH and Pointnext products from product line 96.
HPE will validate reported sales against sell out reports and will use its best efforts to update the Partner weekly via email.
The Event is expected to take place in October 2019 (final dates to be confirmed by HPE at its discretion).
HPE will fund the following in relation to the Event for each winning Partner representative: Return flights from London to Abu Dhabi, two nights accomodation (including breakfast) at the Yas Hotel; driving experiences, watersports, arranged excursions, VIP club access and organized meals. All other expenses will be the sole responsibility of the participants or their employers (eg spending money, transport to and from the airport, activities or meals not organized by HPE, and appropriate medical insurance). There is no cash alternative for the prize.
The winning Partners will be announced no later than 9th August 2019. Each winner will be notified of the number of spaces won and will be invited to nominate a representative(s) to attend the Event. Each winner will confirm the identity of their representative(s) to HPE as soon as possible, and not later than 23rd August 2019.
HPE shall report and settle income tax at 40% on the incentives Partners (and their chosen employee representative(s)) receive under this Incentive Scheme by way of its Taxed Award Scheme (TAS) with HM Revenue & Customs (HMRC) under reference 924/IAU/RB01437. Partners (and/or their representative(s), as the case may be) remain responsible for reporting and paying to HMRC any additional income tax due in connection with incentives they receive under this Incentive Scheme. Partners (or their individual representative(s), as relevant) shall provide the representative(s)’ Full Name and National Insurance Number or Date of Birth and Home Address to HPE no later than 30th August 2019.
HPE reserves the right to (i) amend, modify, cancel or withdraw this Incentive Scheme at any time without prior notice; and/or (ii) replace the prize with an alternative prize of equal value if circumstances beyond HPE’s control makes it necessary to do so.
In the unlikely event of any dispute, the decision of HPE or its subcontractor shall be final.
HPE cannot guarantee the performance of any third party and to the extent permitted by law shall not be liable for any act or default by a third party. Participants in this Incentive Scheme agree that to the maximum extent permitted by applicable law, HPE will have no liability whatsoever for any injuries, losses, costs, damage or disappointment of any kind resulting in whole or in part, directly or indirectly from acceptance, misuse or use of a prize, or from participation in any of the trip activities, or from participation in this Incentive Scheme.
These Terms and Conditions are governed by the laws of England and Wales.
